I'm out of state. Do I need a Virginia license to ship there?
Generally yes. Under Virginia law, sellers of nicotine and vapor products must be licensed whether inside or outside the Commonwealth. These requirements originated with the Department of Taxation and are transitioning to Virginia ABC effective October 1, 2026.
What about the federal PACT Act?
The PACT Act (extended to vapor products) requires remote sellers of tobacco and vapor products to register with the ATF and the state, verify age, and file monthly reports. It applies on top of Virginia's rules.
Do remote cigar or pipe tobacco sales need anything?
Yes. Remote online sales of cigars or pipe tobacco to Virginia consumers require a separate remote retail seller license, even though those products are exempt from the in-store retail permit.
