Virginia ABC Tobacco Inspections

Beginning October 1, 2026, oversight of retail tobacco and nicotine sales moves from the Department of Taxation to the Virginia Alcoholic Beverage Control Authority (Virginia ABC). Virginia ABC is authorized to conduct routine, unannounced inspections and compliance checks to confirm retailers are permitted and following the rules.

The law provides for unannounced buyer or compliance operations at least once every 24 months, and Virginia ABC may inspect more often. Because checks are unannounced, staying continuously compliant is the safest approach.

Inspections generally confirm that a store holds a valid Retail Tobacco Permit, verifies customer age correctly, posts required signage, keeps proper records, and sells only certified vapor and nicotine products. Refusing an inspection can itself carry penalties.

For violations tied to the permit, Virginia ABC can suspend the permit and impose civil penalties of up to $2,000 for a first violation and $5,000 for a second within five years. If the violation involved selling to a prohibited person such as a minor, the caps rise to $3,000 for a first violation and $6,000 for a second. The Board may also require the permittee to pay its investigation and hearing costs, up to $25,000. These permit penalties are separate from the penalty for the sale itself.

Separate from the permit penalties, Virginia Code 18.2-371.2 sets a civil penalty for the sale itself: $500 for a first violation and $2,500 for a second or subsequent violation within three years, plus an additional $100 that may be assessed against the employee responsible.

Under the new law, selling vapor or nicotine products that are not on the state certification directory can bring escalating fines of $5,000, then $10,000, then $15,000 per product for repeat violations. Amounts are set by law and subject to change.
