Penalties for Violations

Permit Penalties (Virginia ABC)

The Board can suspend your permit and impose civil penalties up to $2,000 for a first violation and $5,000 for a second within five years. If the violation involved selling to a prohibited person such as a minor, the caps rise to $3,000 and $6,000. The Board may also require you to cover its investigation and hearing costs, up to $25,000.

Selling to a Minor

A separate civil penalty of $500 for a first violation and $2,500 for a repeat within three years, plus $100 assessed against the employee. (Va. Code 18.2-371.2)

Selling Uncertified Products

$5,000, then $10,000, then $15,000 per product for repeat violations under the new law.

No Permit or Refusing Inspection

Selling without the required permit after October 1, 2026 may result in misdemeanor criminal charges, and refusing an inspection can bring added penalties.

Questions

Virginia Tobacco Inspection FAQ

Who inspects tobacco retailers in Virginia?
Beginning October 1, 2026, oversight of retail tobacco and nicotine sales moves from the Department of Taxation to the Virginia Alcoholic Beverage Control Authority (Virginia ABC). Virginia ABC is authorized to conduct routine, unannounced inspections and compliance checks to confirm retailers are permitted and following the rules.
How often will inspections happen?
The law provides for unannounced buyer or compliance operations at least once every 24 months, and Virginia ABC may inspect more often. Because checks are unannounced, staying continuously compliant is the safest approach.
What do inspectors check?
Inspections generally confirm that a store holds a valid Retail Tobacco Permit, verifies customer age correctly, posts required signage, keeps proper records, and sells only certified vapor and nicotine products. Refusing an inspection can itself carry penalties.
What penalties can Virginia ABC impose on my permit?
For violations tied to the permit, Virginia ABC can suspend the permit and impose civil penalties of up to $2,000 for a first violation and $5,000 for a second within five years. If the violation involved selling to a prohibited person such as a minor, the caps rise to $3,000 for a first violation and $6,000 for a second. The Board may also require the permittee to pay its investigation and hearing costs, up to $25,000. These permit penalties are separate from the penalty for the sale itself.
What are the penalties for selling to a minor?
Separate from the permit penalties, Virginia Code 18.2-371.2 sets a civil penalty for the sale itself: $500 for a first violation and $2,500 for a second or subsequent violation within three years, plus an additional $100 that may be assessed against the employee responsible.
What are the penalties for selling uncertified products?
Under the new law, selling vapor or nicotine products that are not on the state certification directory can bring escalating fines of $5,000, then $10,000, then $15,000 per product for repeat violations. Amounts are set by law and subject to change.
How can I prepare my store for an inspection?
Make sure your permit is current, your staff are trained to check ID every time, required signage is posted, and your records are in order. Our service handles the permit and coordinates CERT VA training so your team is ready before an inspector ever walks in.
